Enforcement Action Alleges Illegal Price Coordination Via Algorithmic Rent Setting Known for Artificially Inflating Rent Prices
Mayor Brett P. Smiley today announced that the City of Providence has filed an enforcement action against Audubon Capital Partners, LLC alleging unlawful engagement in rent price coordination via algorithmic device setting. Algorithmic pricing software is used to analyze public and private market trends and occupancy rates in a given area and was banned in Providence last year to prevent price-fixing patterns that drive up rental prices.
“When corporations unlawfully utilize these algorithms to artificially raise rent prices, we will hold them accountable,” said Mayor Brett Smiley. “Across the country we have seen the use of algorithmic software create unfair housing markets that prioritize profit, reduce competition and drive-up rent prices. I’m proud to be taking action on behalf of our neighbors today and will continue to advocate for further projections against these unfair practices at the State level.”
The complaint, which alleges a violation of Chapter 13, Article X, Section 13-70 of the Providence Code of Ordinances, holds a penalty of $500 per day. Audubon Capital Partners, LLC has been ordered to appear before a judge of the Providence Municipal Court on June 1, 2026.
“We banned algorithmic rental price fixing in Providence because housing is not a game for corporations to rig. After constituents brought this to our attention, we investigated and are now filing suit to hopefully hold this company accountable,” said Councilman John Goncalves. “Let us be clear, using software to manipulate rents and squeeze residents is unacceptable and we will not tolerate it. I am grateful to the constituents who spoke up and helped us take action to protect our community.”
